Privacy Policy
This Privacy Policy and its appendix (“Privacy Policy”) explain how JaiDee Technologies co., ltd., its affiliates, associates, related companies, and jointly controlled entities (collectively “JaiDee”, “Company”, “we”, “us” or “our”) collect, use, process, and disclose your personal data through your use of JaiDee’s platforms and websites (collectively “Platform” and “Website”) as well as other products, features, and services operated by JaiDee (collectively “Services”).
This notice applies to our users (collectively referred to as "you" or "your").
“Personal Data” means any information which can be used to identify you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, bank account and credit card details, personal interests, email address, your image, government-issued identification numbers, biometric data, race, date of birth, marital status, religion, health information, vehicle and insurance information, employment information, and financial information.
Generally, we collect, use, disclose, or process your personal data in accordance with this Privacy Policy with your consent or as required by applicable laws, such as in the following cases:

Sensitive Personal Data
Some of the personal data we collect may be sensitive. This may include personal data relating to race, national identification card data, religious beliefs, background history (including financial and criminal records, where permitted by law), health information, disability, marital status, and biometric data, as appropriate. We will collect sensitive personal data only with your consent and/or in strict compliance with applicable laws. In the event that you submit any documents or information to us for any purpose which may contain such sensitive personal data (which is not necessary for that purpose), you agree to redact such sensitive personal data before submitting the document or information to us.
JaiDee will collect, use, and disclose personal data only with the consent of the individual or as permitted by applicable laws and regulations.
2. Use of Personal Data
JaiDee will process your personal data based on necessity, categorized into "Mandatory Purposes" for which you must provide information to receive services (without which the Company may not be able to deliver services to you) and "Optional Purposes" for which you can choose to provide consent or refuse processing, as detailed below:
Purposes of personal data processing:
To verify identity, age, and eligibility criteria for considering loan requests or financial services, as well as to verify to prevent money laundering, terrorism financing, or any other offenses.
To administer and manage loan accounts, limits, websites, platforms, and various services provided to you.
To assess and review credit risk, check business status, as well as data analysis when you or a guarantor apply for services.
To prepare and develop credit risk measurement modeling structures for the company.
To regularly monitor and track your creditworthiness level.
To maintain, research, and increase the efficiency of new products, solutions, or financial innovations.
To calculate and identify total debt obligations, including the total amount due according to the schedule.
To track and accelerate debt collection and manage disputes related to your account or security provider.
To be used in research, testing, or statistical analysis to develop the efficiency of information systems, operations, and service delivery.
To analyze usage behavior to improve platform experience, present information that meets needs, and facilitate usage.
To monitor, suspend, and resolve cases where there is a violation of agreements, internal policies, or provisions of law.
To comply with laws, court rulings, or orders of government agencies (such as anti-money laundering or tax laws), as well as payment network rules.
To restrain financial damage, report illegal behavior, or for the company's legal claims exercise.
To disclose information in evaluating rights transfer, joint credit consideration, or debt claim transfer of the company.
To be used in due diligence for cases of acquisition, merger, or financial structure transactions.
To protect safety and maintain the stability of user accounts, financial transactions, services, and information networks.
To manage risk, prevent and monitor fraud, or improper activities to protect the image and reputation of JaiDee.
To coordinate and facilitate the provision of joint services with the company's partners or vendors.
To protect and enforce the legal rights entitled to both the company and customers.
To promote safety mechanisms and prevent fraudulent activities related to accessing services.
To be used in performing marketing communication, promotions, sales promotion activities, including invitations to participate in research or answer surveys.
Any other purposes related to or following from activities according to items 1 - 21 specified above.
Classification and Legal Basis:
Mandatory Purposes: Activities according to items 1 - 20 and item 22 are considered necessary conditions for receiving services. If you do not provide such personal data, JaiDee may not be able to deliver services to you.
Optional Purposes: Activities according to item 21 (Marketing) and item 22 specifically as related to item 21 are optional, and you retain the right to decline data processing.
For the above data processing, JaiDee relies on legal bases according to the provisions of the Personal Data Protection Act, namely (1) Contractual basis (for preparation or performance of a contract), (2) Legal obligation basis, (3) Legitimate Interest basis of the company or others, and/or (4) Consent basis, as the case may be.
Safety and Security
We use your data to ensure the safety of our services and all users, including:
The system will verify your identity when you log into the platform.
Using device data, location, profile, usage, and other personal data to prevent, detect, and combat fraud or unsafe activities.
Monitoring compliance with our terms and conditions and policies.
User Support
We use personal data to resolve user support issues. For example, we may perform the following:

We may use your personal data when we are required to do so, received instructions, suggestions, expectations, or requests from our legal advisors or legal agencies, regulatory agencies, government agencies, or any other agencies both domestically and internationally.

Please note that even if you choose not to receive marketing or promotional communications, JaiDee may still send messages related to your account and/or services (such as two-factor authentication, transaction information, rewards, etc.).
3. Disclosure of Personal Data
We share personal data with affiliates, associates, companies under joint control, and other affiliates. JaiDee group companies share resources such as infrastructure and technology with each other to provide you with a consistent, relevant, and secure experience when you use our products or services, and for the purposes stated in this Privacy Policy.
With JaiDee's service providers and business partners
We may disclose personal data to vendors, advisors, marketing partners, research firms, and other service providers or business partners, including:
Payment service providers and facilitators;
Debt collection companies;
Credit bureaus, alternative credit rating agencies, and other credit reporting organizations;
Background check and anti-money laundering service providers;
Cloud storage service providers;
Document storage and management service providers;
Advertising and marketing partners and platform providers;

Research partners, including those conducting surveys or research projects;

With help from our legal advisors and government agencies
We may disclose your personal data to legal advisors, law enforcement officials, government agencies, and other third parties. Such actions may occur for legal purposes (mentioned above) or in any of the following cases:
In case it is necessary to respond to an emergency threatening the life, health, or safety of a person; or
In case it is necessary for the public interest (e.g., in a public health crisis, for contact tracing, and community protection).
Business Transfer
We may disclose your personal data to other persons in cases related to acquisition, sale, merger, joint venture, consolidation, restructuring, financing, or any other type of business transaction. However, your personal data will remain under our obligations set forth in the previous privacy policy you agreed to.
JaiDee will not sell, rent, or disclose your personal data for any other purposes unless prior consent is obtained from you according to the law.
4. Retention of Personal Data
We will retain your Personal Data for the period necessary to fulfill the purposes outlined in this notice, unless a longer retention period is required or permitted by law. When your Personal Data is no longer necessary for the services or purposes, or we no longer have a legal or business purpose to retain it, we will proceed to delete, destroy, anonymize, or prevent access to or use of such Personal Data for any purpose other than compliance with this notice, or for safety, security, fraud prevention, and detection purposes, as required by applicable laws. The retention period for your Personal Data will be determined based on the duration of your contract or relationship with us, plus any additional period required by applicable laws (for example, Anti-Money Laundering laws or tax laws).
5. Cross-Border Data Transfer
We may transfer, store, or disclose your personal data to third parties abroad. When we transfer your personal data to any third party, we will comply with legal obligations and regulations relevant to your personal data, including having a legal basis for data transfer and providing appropriate safeguards to ensure that personal data is protected at an adequate level. We will also ensure that recipients are obligated to protect your personal data at a level of protection equivalent to the protection under applicable laws.
Our legal principle will be based on consent (e.g., we may ask for your consent to transfer your personal data) or one of the safeguards permitted by law.

JaiDee and third parties we partner with may use cookies, web beacons, tags, scripts, local shared objects such as HTML5, advertising identifiers, and similar technologies (e.g., software development kits (SDK)) (collectively “Cookies”) in our website and platform usage, which may be permanent cookies or stored only during a browser or device session.
Cookies may contain unique identifiers and may be stored in several places such as your computer or mobile device, in emails we send to you, and on our web pages. Cookies may be used for various purposes such as:
Providing basic functions necessary for using our website and platform.

7. Rights of Data Subjects
Under the Personal Data Protection Act B.E. 2562 (2019), you, as a data subject, have the following rights regarding your Personal Data, subject to conditions and exceptions established by law:

Right to Access: You have the right to request access to and obtain a copy of your Personal Data under our responsibility.

Right to Erasure or Destruction: You have the right to request us to delete, destroy, or anonymize your Personal Data in cases prescribed by law.
